Tajarat Platform Terms of Use

For Customers and Users

Article (1): Introduction

The Platform enables users to browse, compare, order and purchase products and services offered by Merchants, and to benefit from the related electronic services.

These Terms and Conditions govern use of the Tajarat website, application and related services, and define the rights and obligations of the user, the Platform and the Merchants within the scope of the Platform's business model.

Please read these Terms carefully before creating an account, using the Platform or completing any order.

Chapter One

Definitions and Scope of Application

Article (2): Definitions

For the purposes of these Terms, the following words and expressions shall have the meanings set out below, unless the context requires otherwise:

Platform: the Tajarat platform, its website, applications, systems and related digital services.

User: any person who uses or browses the Platform, creates an account or interacts with its content.

Customer: a User who purchases or attempts to purchase a product or service through the Platform.

Merchant: the natural or legal person approved by the Platform to display and sell products or services through the Platform.

Product: any goods, digital product or service that the Platform permits to be offered, according to the nature of the available services.

Order: a purchase request submitted by the Customer through the Platform.

Account: the electronic account created in the User's name.

Services: all services and functions made available by the Platform to Users.

Policies: the policies and regulations published on the Platform and referred to in these Terms.

Article (3): Scope of the Terms

These Terms apply to all use of the Platform by Customers, including:

Creating an account.

Browsing products.

Adding products to the cart.

Submitting orders.

Payment.

Shipping and delivery.

Cancellation.

Returns and refunds.

Ratings and reviews.

Use of support and customer service.

Chapter Two

Acceptance and Eligibility

Article (4): Acceptance of the Terms

A User's creation of an account, use of the Platform or completion of an Order after these Terms have been made available shall constitute acceptance of these Terms, to the extent permitted by law.

Where the Platform requires express consent, such consent shall be obtained through an appropriate electronic method, and the system shall retain a record of the consent and the version that was accepted.

Article (5): User Eligibility

Use of the Services requires the User to have the legal capacity necessary to enter into the transactions carried out through the Platform.

If certain Services require a particular age or legal capacity, those Services may only be used by persons who meet such requirements.

The person using the Account is responsible for ensuring that their use of the Platform complies with the law.

Article (6): Accuracy of Information

The User undertakes that the information provided to the Platform shall be:

Correct.

Accurate.

Complete.

Up to date.

The Platform may request additional information to verify the User's identity or the accuracy of the data, or to protect the Platform and Customers from fraud.

Chapter Three

Account Creation and Management

Article (7): Account Creation

Certain Services may require creation of an Account.

When registering, the User shall:

Provide accurate information.

Use their own personal information or information they are legally entitled to use.

Not create accounts for the purpose of circumventing rules or controls.

Not impersonate another person.

Update information when it changes.

Article (8): Account Security

The User is responsible for maintaining the confidentiality of the login credentials for their Account.

The User must notify the Platform immediately upon:

Loss of login credentials.

Suspected compromise of the Account.

Discovery of unauthorized use.

Receipt of unusual notifications relating to the Account.

The Platform may take immediate security measures to protect the Account, the User or the Platform.

Article (9): Multiple Accounts

Multiple Accounts may not be created for the purpose of:

Obtaining promotions unlawfully.

Circumventing restrictions.

Circumventing cancellation or refund policies.

Manipulating ratings.

Committing fraud.

The Platform may take appropriate action upon discovering such conduct.

Chapter Four

Nature of the Tajarat Platform and the Relationship Between the Customer and the Merchant

Article (10): Nature of the Business Model

Tajarat operates as an electronic platform that brings together Customers and Merchants and provides the technical environment required to display products, manage Orders and provide related services.

Depending on the nature of the product and service, the Merchant may be the seller or supplier contracting directly with the Customer, while the Platform provides technical, logistics or other services as determined by the Platform.

Where required or appropriate, the identity of the party responsible for the sale or performance of the service shall be identified on the product page, Order, invoice or another electronic means.

Article (11): Merchant Responsibility for the Product

Within the limits of the Merchant's legal and contractual role, the Merchant remains responsible for:

The legality of the product.

Its source.

Its conformity with the description.

Its quality and safety.

Any warranties it provides.

Required documents and licenses.

Performance of product-related obligations imposed by law.

Nothing in this Article prevents the Customer from exercising any legal right against the Merchant.

Article (12): Product Information

The Platform exercises reasonable care in displaying product information; however, some information is entered or provided by the Merchant.

The User must review the product information before completing an Order.

A Merchant may not publish false or misleading information or conceal material information about a product.

The Platform reserves the right to correct, suspend or remove any content or product that violates its Policies or the law.

Chapter Five

Prices and Promotions

Article (13): Prices

Prices and fees associated with an Order are displayed in the purchasing interface before the Order is completed, according to the nature of the service.

The User must review the final price, fees and delivery information before confirming the Order.

Article (14): Obvious Pricing Errors

If an incorrect price appears due to an obvious technical or human-entry error, the Platform may take the measures necessary to correct the error.

Where the error affects an Order that has already been submitted, it shall be handled in accordance with the law and the circumstances of the case, with the Customer being notified as appropriate.

Article (15): Promotions and Vouchers

Promotions, vouchers and discounts are subject to their specific terms, including:

Promotion period.

Number of permitted uses.

Minimum purchase amount.

Included products.

Eligible categories.

Promotions may not be used fraudulently or in breach of their conditions.

Chapter Six

Orders and Formation of the Transaction

Article (16): Submitting an Order

Before an Order is submitted, the Platform provides the User with an appropriate opportunity to review the essential Order information and correct input errors, in accordance with applicable legal and technical requirements.

The User must review:

Products.

Quantities.

Price.

Delivery address.

Payment method.

Fees.

Order-specific notes.

Article (17): Order Acknowledgment

An electronic acknowledgment confirming receipt of the Order shall be sent through the method adopted by the Platform.

Sending an acknowledgment of receipt does not necessarily mean that the Order has been finally accepted if the Platform has stated otherwise.

Article (18): Order Acceptance

An Order becomes accepted in accordance with the Platform mechanism disclosed to the User.

An Order may be refused or cancelled for legitimate reasons, including:

Product unavailability.

A material error in the price or description.

Suspected fraud or misuse of the Service.

Inability to deliver.

The Order violates the law.

A material technical or operational reason.

Where the Customer has paid an amount for an Order that is cancelled, the refund shall be processed in accordance with the applicable Policy and the law.

Article (19): Order Cancellation

The Customer may cancel an Order in the circumstances and within the time limits specified in the Cancellation and Returns Policy, taking into account the nature of the product, the stage of fulfilment and any mandatory rights established by law.

Chapter Seven

Payment and Settlements

Article (20): Payment Methods

The Platform makes available the payment methods it determines from time to time.

Payments may be processed through licensed or specialized payment service providers.

When using a particular payment method, the User agrees to comply with the terms of the relevant payment service provider.

Article (21): Lawful Use of Payment Methods

The User represents that they are entitled to use the payment method used, and is prohibited from:

Using another person's card without authorization.

Using unauthorized accounts or wallets.

Providing false payment information.

Carrying out transactions for the purpose of fraud or circumventing the system.

Article (22): Amounts Improperly Owed

If amounts are found to be due from the User as a result of error, fraud or unlawful use, the Platform may take appropriate legal and technical measures to recover its rights, subject to the law.

Chapter Eight

Shipping and Delivery

Article (23): Delivery

Delivery is carried out in accordance with the options and timeframes shown during the Order process.

Delivery may be performed by:

The Platform.

The Merchant.

An independent shipping company.

Another logistics service provider.

Article (24): Delivery Information

The User is responsible for the accuracy of the delivery address and contact information provided.

Providing incorrect information may result in:

Delivery delays.

Failed delivery.

Additional costs, where lawful and disclosed.

Return of the Order to its source.

This does not prevent the application of any Customer rights established by law.

Article (25): Delays

The Platform and relevant service providers exercise reasonable care to complete delivery within the announced timeframes.

The Platform is not responsible for delays resulting from circumstances beyond its reasonable control, without prejudice to the Customer's legal rights.

Chapter Nine

Returns and Refunds

Article (26): Returns Policy

Returns, exchanges and refunds are subject to:

Rights established by law.

The published Returns and Refunds Policy.

The nature of the product.

The condition of the product.

The stage reached in fulfilment of the Order.

No internal policy may reduce a mandatory consumer right.

Article (27): Defective or Non-Conforming Products

If a product is defective or does not conform to the specifications or advertised description, it shall be handled in accordance with the applicable laws and Policies.

Depending on the circumstances, the remedy may include:

Repair.

Replacement.

Refund.

Any other remedy required by law.

Article (28): Refunds

Refunds shall be made through the original payment method or another method permitted by law and the policies of the payment service provider, depending on the nature of the transaction.

An additional period determined by the bank or payment service provider may be required for the refunded amount to appear in the Customer's account.

Chapter Ten

Consumer Rights

Article (29): Statutory Rights

These Terms are not intended to restrict or exclude any right granted to consumers under applicable laws.

The Platform recognizes the Customer's right to receive correct information regarding products and services and the protection afforded by law.

Neither the Platform nor any party contracting with it may use a contractual term intended to exempt a supplier from a mandatory obligation imposed under consumer protection law.

Chapter Eleven

Ratings and Reviews

Article (30): Right to Submit a Rating

A Customer who has completed a genuine purchasing experience may submit a rating or review in accordance with the Ratings and Reviews Policy.

Article (31): Prohibited Ratings and Reviews

The following are prohibited:

Publishing fake reviews.

Purchasing reviews.

Creating Accounts to manipulate ratings.

Threatening a Merchant or Customer to obtain a particular rating.

Publishing personal data.

Publishing content that violates the law.

The Platform shall not remove a review merely because it is negative if it is based on a genuine experience and does not violate the Policy.

Chapter Twelve

Content and Intellectual Property Rights

Article (32): User Content

The Platform may allow Users to publish:

Ratings.

Images.

Comments.

Questions.

Other product-related content.

The User represents that they have the right to publish the content they provide and that such content does not infringe the rights of others.

Article (33): License to Content

To the extent necessary to operate the Services and display content, the User grants the Platform a non-exclusive license to use content they publish through the Platform, including storing, displaying, formatting and distributing it within the Services.

Ownership of the content does not transfer to the Platform.

Article (34): Removal of Content

The Platform may remove or suspend any content if it:

Violates the law.

Violates these Terms.

Infringes third-party rights.

Contains abuse or threats.

Contains personal data unlawfully.

Creates a security or technical risk.

The Intellectual Property Policy and infringing-content takedown procedure apply to intellectual property reports.

Chapter Thirteen

Acceptable Use

Article (35): Prohibited Uses

The User is prohibited from:

Hacking the Platform.

Disrupting the Services.

Introducing malicious software.

Using unauthorized automated tools.

Attempting to access the Accounts of others.

Automated extraction of data without authorization.

Circumventing protection systems.

Exploiting technical vulnerabilities.

Using the Platform for unlawful activity.

Using the Platform to commit fraud.

Chapter Fourteen

Fraud Prevention and Risk Management

Article (36): Fraud Prevention

The Platform may use technical and analytical methods to detect and prevent suspicious transactions.

Where reasonable grounds exist, the Platform may take measures including:

Requesting additional information.

Verifying identity.

Suspending an Order.

Delaying certain transactions.

Suspending an Account.

Cancelling the transaction in accordance with the law.

Article (37): Non-Disclosure of Fraud-Prevention Mechanisms

The Platform is not required to disclose details of its fraud-detection systems or internal risk criteria where disclosure could weaken the Platform's security or enable circumvention.

Chapter Fifteen

Privacy and Data Protection

Article (38): Data Processing

Personal data is processed in accordance with the Privacy Policy and applicable laws.

Potential processing purposes include:

Account creation.

Order fulfilment.

Payment.

Delivery.

Customer service.

Security and fraud prevention.

Legal compliance.

Service improvement.

Article (39): Data Subject Rights

The Platform handles data subject requests in accordance with the law and the Privacy Policy, including requests relating to access, correction or deletion where permitted by law.

The User acknowledges that certain data may need to be retained for a period of time to meet legal obligations, protect rights or manage disputes.

Article (40): Cookies

The Platform uses cookies and similar technologies in accordance with the published Cookie Policy.

Chapter Sixteen

Cybersecurity

Article (41): Platform Security

The Platform implements appropriate technical and organizational measures to protect its systems and User data.

However, no electronic service can be guaranteed to be absolutely immune from all technical risks.

Article (42): User Security Obligations

The User shall not:

Share passwords.

Knowingly use unsafe devices or systems.

Attempt to hack the Platform.

Report vulnerabilities in a manner that places data or systems at risk.

Any vulnerability or security incident must be reported through the official channels.

Chapter Seventeen

Account Suspension and Termination

Article (43): Account Suspension

The Platform may temporarily suspend an Account where necessary:

To protect the User.

To protect the Platform.

To prevent fraud.

To investigate a violation.

To comply with legal requirements.

To prevent misuse of the Service.

Where possible, the action shall be proportionate to the nature of the risk.

Article (44): Account Termination

An Account may be terminated in serious or repeated cases, including:

Fraud.

Hacking systems.

Identity impersonation.

Unlawful use.

Repeated violations.

Termination of the Account does not affect rights and obligations that arose before termination.

Chapter Eighteen

Limitations of Platform Liability

Article (45): Scope of Liability

The Platform shall be responsible for its Services and obligations to the extent required by law and the applicable contracts.

The Platform shall not be responsible for damage arising exclusively from:

Incorrect information provided by the User.

Unlawful use of the Account.

An independent act of a third party that cannot be attributed to the Platform.

Events beyond reasonable control.

Use of a product contrary to the instructions of the manufacturer or Merchant.

No provision of these Terms shall be interpreted as excluding liability that cannot lawfully be excluded.

Article (46): Third-Party Services

The Platform may rely on third parties to provide certain services, such as:

Payment.

Shipping.

Hosting.

Messaging.

Technical analytics.

Certain services may be subject to additional terms imposed by the relevant service provider.

Chapter Nineteen

Force Majeure

Article (47): Circumstances Beyond Control

The Platform shall not be responsible for delay or failure to perform an obligation to the extent directly caused by exceptional events beyond its reasonable control, including natural disasters, fires, epidemics, widespread outages, infrastructure disruption, government decisions and severe cyberattacks that could not reasonably have been prevented.

This shall not prejudice any mandatory rights granted to consumers.

Chapter Twenty

Complaints and Dispute Resolution

Article (48): Complaints

A User may submit a complaint through the approved customer service channels.

The Platform shall work to:

Register the complaint.

Verify the facts.

Communicate with the Merchant where necessary.

Take appropriate action.

Inform the Customer of the outcome to the appropriate extent.

Article (49): Product-Related Disputes

If a dispute concerns the quality, conformity or safety of a product for which the Merchant bears direct legal responsibility, the Platform may refer the matter to the Merchant or require the Merchant to address the case, without preventing the Customer from exercising their legal rights.

Chapter Twenty-One

Notices and Electronic Communications

Article (50): Electronic Communications

The User agrees to receive notices relating to the Services, Orders and Account through the electronic contact methods provided to the Platform.

Such methods may include, as available:

Email.

Text messages.

App notifications.

Messages within the Account.

Article (51): Electronic Records

The Platform may retain electronic records relating to Accounts, Orders, consents and communications in accordance with the law and data-retention policies.

Consent records may include:

User identity.

Date and time of consent.

Version of the document.

Method of consent.

Technical data necessary to evidence the consent.

Chapter Twenty-Two

Changes to Services and Terms

Article (52): Changes to Services

The Platform may develop, modify, add or discontinue certain Service functions, in accordance with the law and the nature of the Service.

Article (53): Changes to the Terms

These Terms may be amended from time to time to address:

Legislative changes.

Technical developments.

New Services.

Security requirements.

Operational changes.

The Platform shall specify the effective date of the amended version.

For material amendments, the User shall be notified in an appropriate manner, and continued use of certain Services may require acceptance of the amended version.

Chapter Twenty-Three

Supplementary Documents and Policies

Article (54): Contractual Integration

The following documents supplement these Terms, depending on the nature of the Service:

Privacy Policy.

Cookie Policy.

Returns and Refunds Policy.

Shipping and Delivery Policy.

Ratings and Reviews Policy.

Intellectual Property Policy.

Any other policy expressly referred to on the Platform.

These documents shall be made available to the User electronically.

Chapter Twenty-Four

General Provisions

Article (55): No Waiver

Failure by the Platform to exercise any right at a particular time shall not constitute a permanent waiver of that right.

Article (56): Severability

If any provision of these Terms becomes unenforceable or inapplicable, the remaining provisions shall not be affected, and, to the extent permitted by law, the invalid provision shall be replaced by a valid provision that most closely achieves the intended legal purpose.

Article (57): No Agency Relationship

These Terms do not create an employment, partnership or agency relationship between the User and the Platform, or between the User and any other party, except for the contractual relationship arising from the purchase of a product or service according to the nature of the transaction.

Article (58): No Effect on Mandatory Rights

No provision of these Terms may be interpreted as:

A waiver by a consumer of a mandatory right.

An exemption of the Platform or Merchant from an obligation imposed by law.

Preventing the User from approaching competent authorities or exercising a legal right.

Chapter Twenty-Five

Governing Law and Jurisdiction

Article (59): Governing Law

These Terms are governed by and interpreted in accordance with the laws of the State of Qatar to the extent applicable.

The competent courts and judicial authorities of the State of Qatar shall have jurisdiction over disputes, subject to any rules of jurisdiction or consumer rights established by law.

Article (60): Integration of Documents

These Terms and Conditions, the Privacy Policy, the Cookie Policy and all Policies referred to on the website or application form an integral part of these Terms, and use of the Platform constitutes express agreement to comply with them.
